By creating an account at gishme.com, by installing the Gish browser extension or mobile application, or by interacting with the Gish API, you agree to these Terms of Service ("Terms"). The contracting entity is Gloconomy, Inc., a Delaware corporation with principal offices in Atlanta, Georgia ("Gish," "we," "us"). The Service is operated under the brand name "Gish" and lives at gishme.com.
"You" means the human or legal entity bound by these Terms. Because Gish hosts five distinct relationships, "you" can mean one of five things, and each carries its own additional terms below:

You must be at least 13 years old to use Gish. Users under 18 must have parental consent to make or receive payments.
Gish is a coordination layer for the giving and receiving of objects, experiences, contributions, and outcomes. The core unit is a wish — a typed, addressable record owned by a User and visible at gishme.com/@user/wish-id. Five wish types are supported, each with distinct rules:
Gish operates across multiple sister applications collectively known as the Experience Layer (Gish, Chowy, Localise, Globalise, Misd) and the Execution Layer (LocoFlow, GlobaFlow). Hemisphere terms are governed by §12.
Gish is an identity-first service. Each User holds a permanent handle (@yourhandle) at gishme.com/@yourhandle. Handles are not transferable, recyclable, or sellable except by formal account transfer initiated by the User and approved by Gish.
You may create wishes by URL paste, browser extension, voice memo, SMS, photo capture, or calendar import. You represent that you have the right to make these wishes and that they comply with our content guidelines (§3.6).
When you send a gift or contribute to another User's wish, you authorise Gish to charge your selected payment method (§10) and to transmit funds to the appropriate retailer, recipient, or escrow account. All purchases are final on dispatch except where §3.3 (refunds) applies.
Gish refunds in three circumstances, in addition to those required by law: (a) the retailer cancels the order; (b) the gift is rejected by the recipient within 7 days; (c) an outcome-fund fails to reach 100% by its deadline (full refund, no fee). Otherwise, refunds are at the discretion of the retailer.
Each User accumulates a trust score based on completed gifts, fulfilled receipts, on-time outcome-fund disbursements, and friend ratings. The score is portable across the hemisphere (§12). Manipulation of the score (sock-puppet ratings, fake gifts) results in account suspension.
You will not: harass other Users; use Gish to launder money; create wishes for illegal items, controlled substances, weapons, hate speech, or sexually explicit content involving minors; circumvent payee verification; impersonate another person; or scrape the Service. We reserve the right to remove any wish, suspend any account, and refer activity to law enforcement.
Wish titles, descriptions, and uploaded media must be lawful, truthful, and non-infringing. We act on credible reports of infringement under the DMCA — send notices to dmca@gishme.com.
We may suspend or terminate any account that violates these Terms, fails identity verification, accrues three or more substantiated trust-score complaints in 90 days, or is used in connection with prohibited activity. Suspended Users receive 30 days' notice and may export their wishlist data per §3.8 of our Privacy Policy.
The Creator tier is a paid upgrade ($49/month, billed monthly or annually) that allows a User to publish editorial wishlists, accept brand partnerships, earn from affiliate links, and access advanced analytics. By activating Creator status, you additionally agree:
Creators earn 30% of net affiliate commissions generated through their published wishlists (after Gish's split with the originating retailer or affiliate network — see §8). Earnings are paid monthly via ACH or PayPal once the balance exceeds $50.
Creators may accept paid partnerships with verified Brands. All paid placements must be disclosed inline using Gish's #partner or #gifted tags, in compliance with the FTC Endorsement Guides (16 CFR Part 255). Failure to disclose results in immediate forfeiture of the placement fee.
Creator content must comply with §3.6 and additionally must not: misrepresent personal use of products, accept payment for negative reviews of competitors, or include affiliate links without genuine recommendation. Editorial integrity is enforced.
Creator status may be revoked for repeated FTC violations, fraudulent earnings, or sustained breach of editorial integrity. Outstanding earnings are paid out at termination in accordance with §4.1.
"Brand" means a verified commercial entity operating a storefront, sponsored category, or paid placement on Gish. Brand status requires identity verification, trademark proof, and a signed Brand Services Agreement.
Verified brand storefronts begin at $2,000/month base + $0.40 per click + 2.5% closed-loop affiliate commission. Custom enterprise pricing available. Storefront content must comply with our brand desk guidelines.
Sponsored Volume placement begins at $25,000 flat per Volume, with one sponsor per Volume cap. The December Holiday Gift Guide Volume is $50,000. Sponsorship grants co-curation rights, back-cover essay, and right of first refusal for the same Volume the following year.
All sponsored content is labelled SPONSORED and dated. Editorial line is owned by Gish; sponsors approve final copy but may not dictate it. Brands must meet our advertiser quality standards (truthful claims, FTC-compliant, no dark patterns).
Brands must accurately represent product availability, pricing, shipping windows, and country of origin. Misrepresentation is grounds for storefront suspension and refund of the placement fee.
The Business tier ($99/month base + $5/employee/month) provides corporate gifting tools, manager dashboards, HR integration, and curated vendor catalogs. Authorised administrators must (a) obtain employee consent before importing personal data such as birthdays; (b) use gift events solely for the recognition purposes described in §3 of our Privacy Policy; (c) maintain a designated data privacy contact.
Employee data imported via HRIS (Workday, BambooHR, Gusto, etc.) is processed solely for the gifting use case. Gish acts as a data processor on behalf of the Business; the Business is the controller. A Data Processing Addendum (DPA) is auto-attached to all Business contracts.
Enterprise contracts begin at $50,000/year and include SSO (Okta, Azure AD, Google Workspace, Ping, Auth0, custom SAML), custom-domain hosting, dedicated CSM, 99.95% uptime SLA, regional data residency, audit log export, and a custom MSA. Enterprise terms supersede these Terms where in conflict, with the limited exception of §11 (arbitration), which applies in all cases.
HR integration data flows are governed by §3 of our Privacy Policy. Read scope is limited to: directory, birthdays, employment dates, manager hierarchy, location, termination dates. Compensation, performance, and protected-class fields are never requested.
Where a signed Enterprise MSA conflicts with these Terms, the MSA prevails — except for §11 (binding arbitration), §3.5 (prohibited content), and any law-mandated provision.
"Payee" means an entity approved to receive outcome-fund disbursements. Payees may be 501(c)(3) non-profits, community funds, fiscal sponsors, or verified individuals (e.g., medical or educational beneficiaries). All Payees are listed in the public Verified Payee Directory at gishme.com/payees.
Payees must complete Know-Your-Business verification through our partner Stripe Connect, including: legal entity name, EIN/SSN/ITIN, beneficial ownership disclosure, and bank account verification via Plaid. Individual payees additionally require government ID and proof of beneficiary relationship.
Payees pay no fee on inbound contributions; the 2.5% outcome-fund service fee (§9) is paid by the contributing User. Payees pay standard ACH fees on disbursement (currently $0.25 per transfer, capped at $5/month).
Disbursements occur within 7 banking days of an outcome-fund reaching 100% or its deadline. Partial disbursements are not made except on funds that reached at least 80% and were approved by the originating User. No funds are disbursed to Payees on Gish's sanctions watchlist.
If a contributing User disputes a disbursement, funds are held for 30 days. Payees must respond to disputes within 14 days. Unresolved disputes are escalated to the Gish trust & safety desk; refunds may be initiated at our reasonable discretion.
Gish participates in retailer affiliate programs. When a friend or contributor purchases an item through a wishlist link, Gish (and, for Creator-published lists, the Creator under §4.1) may earn a commission. This does not affect the price you or your buyers pay.

#partner or #gifted badge.Outcome-fund wishes are escrow-style contributions toward a defined finish line — a trip, a piece of equipment, a medical bill, a community project. Gish charges a flat 2.5% service fee on the contribution, with no percentage taken by payment processors beyond standard interchange (which Gish absorbs). For comparison, GoFundMe charges 2.9% + $0.30 per transaction.
On disbursement, every contributor receives a signed PDF receipt itemising the contribution amount, the recipient, the date, and the outcome description. Receipts are tax-deductible only if the recipient is a 501(c)(3) (we surface this on the wish itself).
Outcome-funds may not be used for: bail, debts owed to government entities, gambling, controlled substances, or any purpose prohibited by §3.5.
Gish supports the following payment methods, processed by our partners:
Payment authorisation is captured at the time of contribution. Settled funds are held in a regulated US-based escrow account for outcome-funds (§9) or transmitted directly to retailers for gift wishes. Gish does not store card numbers — all card data is tokenised by Stripe and never touches our servers.
Before filing arbitration, you agree to first contact legal@gishme.com with a written description of the dispute and your desired resolution. We will respond within 30 days.
Any dispute not resolved informally will be settled by binding individual arbitration administered by JAMS in accordance with the AAA Consumer Arbitration Rules. Arbitration shall take place in San Francisco, California. Each party shall bear its own attorneys' fees, except where the arbitrator determines an award of fees is appropriate.
You and Gish each waive the right to participate in class actions, class arbitrations, or representative proceedings. Disputes must be brought individually.
You may opt out of §11.2 and §11.3 by sending written notice to legal@gishme.com within 30 days of first accepting these Terms, including your full legal name, mailing address, and the statement "I opt out of arbitration."
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The Federal Arbitration Act governs §11.2.
Gish is part of the Experience Layer (Gish, Chowy, Localise, Globalise, Misd) and reciprocates with the Execution Layer (LocoFlow, GlobaFlow). Cross-brand reciprocity is governed as follows:
Your @handle is recognised across all sister applications. Identity changes (handle migration, account deletion) propagate to all hemisphere brands within 24 hours.
Your Gish trust score is portable to and from sister applications. A great gifter on Gish is, by reciprocity, a trusted host on Chowy. Cross-brand abuse (e.g., a sustained pattern of complaints on Localise) may affect your Gish standing.
Sharing of personal data between hemisphere brands is governed by §7 of our Privacy Policy and is opt-in by default. You may toggle individual brand integrations at any time in Settings > Brand sharing.
Each hemisphere brand is operated by a distinct legal entity within the Loconomy corporate group; these Terms govern only your relationship with Gish.
We may modify these Terms from time to time. Material changes (definition of material at our reasonable discretion, but always including changes to fees, dispute resolution, or data practices) will be communicated by:
Continued use of the Service after the effective date constitutes acceptance. If you do not accept, you may terminate your account at no cost; outstanding payee disbursements and refunds will complete normally.
Non-material changes (typo corrections, clarifying language) take effect on posting and are logged in the public changelog.
